Definitions

GT Towing Ltd shall be referred to in this document as “the Company”.
The “Hirer” is the person whose name & address appears on the hire contract of which these terms and conditions form a part. The hirer must be at least 18 years old. The Hirer accepts full legal liability for all the equipment listed on the hire contract irrespective of whether the equipment is for the Hirer’s personal use, or that of another member of their party, booking under the same contract booking number.

“Equipment” includes roof racks, fittings, cycle carriers, roof boxes & any other items hired by the Hirer from the Company. The hire period is the date from which the equipment is collected by the hirer from the Company, until the date that the hirer is due to return the equipment. Both these dates are clearly stated on the hire contract.

Conditions of Hire

Liability

The Hirer accepts full personal liability for the equipment from the time the Hirer receives it from a member of the Company’s staff, until it is returned to the Company at the end of the hire period.
The Company reserves the right to charge the hirer the full replacement cost of such equipment if it becomes damaged, lost or stolen during the period of hire.
The replacement costs are as follows:

Roof rack: £95.00 - Roof Box M: £425.00 - Roof Box L: £475.00 - Roof Box XL: £675.00 – Keys: £6.00 (key stuck in lock £50) each - Roof Mounted Bike Carriers: £95 each

The Company will undertake to reasonably highlight any damage prior to the hire commencing, noting this on the hire sheet as appropriate. The Hirer is welcome and encouraged to inspect the equipment at the point of hire before accepting responsibility for the equipment.

If your vehicle has a sun-roof, you must not open this whilst a roof rack or box is fitted. Doing so may damage to roof rack, roof box or bike racks, as well as your own vehicle.

Collecting Equipment

The Hirer will sign a receipt for the equipment on collection. By signing, the Hirer acknowledges that they have inspected the equipment, confirms that it is the equipment ordered & that it is in satisfactory working order and condition. A demonstration of how to operate the equipment will be given, and any questions about the safe and correct operation of the equipment should be asked at this time. If you are not sure about anything, please ask before you take responsibility for the equipment.

Cancellations

If you need to cancel your booking, your initial deposit will not normally be refunded, however depending on the notice provided and the time of year exceptions can be allowed. Booking deposits cancelled for peak dates will not be refunded. Please contact us as soon as you know you will not be able to make the booking to maximise the chances we can return your deposit.

Product Alternatives

It is possible that the equipment which you have pre-booked may have been lost or damaged by a previous hirer. In this event, the Company will use every endeavour to provide the Hirer with equipment of at least the same quality & value as that ordered by the Hirer, although this cannot be guaranteed. Should the Hirer not wish to take the alternative equipment offered, he/she will be entitled to a full refund in respect of the missing equipment. However, the Company accepts no further liability.

If the Company cannot provide an alternative a full refund will be offered.

Returning Equipment

Where the Hirer does not return the equipment at the pre-booked intended end of the hire period, the Company reserves the right to charge the Hirer at the day rate. The amount repayable will accrue up to the replacement cost of the equipment, as specified in the liability section above, together with any legal fees or associated recovery costs.

All items hired must be returned in the condition that items were collected. Roof boxes must be cleaned inside and outside, and free of any sand. A cleaning charge of £60 is payable if hired goods are not returned clean and tidy, or returned with any traces of sand.

Deposits

The Company will charge each Hirer a minimum deposit of £60.

The Company reserves the right to refuse to hire equipment to any client with whom it does not wish to enter a contractual relationship. The Company reserves the right to cancel a contract at any time & without notice, whereupon it will refund to the Hirer any monies paid. Following such a refund, no further liability will exist between the Hirer & the Company.

Equipment Hired

The Company will fit all equipment in accordance with current product guidelines. If the Hirer removes any of the equipment during the hire, they must ensure it is refitted in the correct manner or else damage to our equipment or the Hirers vehicle can occur. We cannot be held responsible for damage caused due to incorrect fitting once the Hirer has left the premises and taken responsibility for the equipment, and replacement costs will be as listed in this document should any damage or losses occur due to incorrect fitment after the initial installation.

Liability

Save as provided in these conditions & to the extent that the exclusion or restriction of liability may be prohibited by statute, the Company will not be liable for any loss, damage or injury caused, directly or indirectly by the equipment or its use. Your statutory rights are not affected.
